General Terms and Conditions of Hire (AMB) of Thömus AG and Thömus Bike World AG

1. General

1.1 These T&Cs govern the business relationship between Thömus / Thömus Bike World (hereinafter referred to as the ‘Lessor’), based in Oberried, and the Lessee (hereinafter referred to as the ‘Lessee’) with regard to the hire of bicycles and accessories.


1.2 By booking and using a rental bike, the renter confirms that they have read and unconditionally accept the AMB.

2. object of hire

2.1 The Rental Firm shall provide the Hirer with a roadworthy bicycle. The Hirer is obliged to check the rented vehicle for recognisable damage and to test the functionality of the brakes and gears before setting off. Complaints on the part of the Hirer must be reported to the Rental Firm when the vehicle is handed over.

2.2 The Hirer must identify himself with an official document (identity card, ID, driving licence, GA, ½-tax subscription).

2.3 Accessories such as helmets, locks or baskets may also be provided, subject to availability.

3. Rental period and return

3.1 The hire period begins when the bike is handed over to the Hirer and ends when it is properly returned to the Rental Firm.

3.2 The Hirer is obliged to return the bicycle by the agreed date at the latest.

3.3 An extension of the rental relationship is only possible with the agreement of the Rental Firm before the end of the current rental relationship. The Rental Firm may refuse the extension without giving reasons. The rental price will be recalculated and the surcharge must be paid at the latest when the bike is returned.

3.4 Late returns may incur additional costs.

4. Obligations of the renter

4.1 Insurance is the responsibility of the Hirer. By concluding the hire contract, the hirer confirms that he/she has liability insurance and thus sufficient cover for the risks associated with riding the bicycle. Liability also extends to damage costs such as expert costs, depreciation or rental cancellation costs.

4.2 The renter undertakes to comply with the Road Traffic Act and to use the rental vehicle and any accessories properly and carefully. It is not permitted to drive a hire vehicle in a state of reduced responsiveness, caused in particular by alcohol, medication, drugs, fatigue or illness.

4.3 The Hirer is obliged to treat the bicycle with care and only use it for its intended purpose.

4.4 The Hirer may not sublet the bicycle to third parties or allow third parties to use it.

4.5 Damage to or loss of the bicycle must be reported to the hire company immediately.

4.6 Accidents and falls resulting in material damage must always be reported to the Rental Firm immediately. If persons are injured and/or property damage is caused to third parties or if a third party is involved as a possible (co-)perpetrator, the police must be contacted immediately and an accident report completed. A copy of this must be sent to the Rental Firm.

4.7 The Hirer is obliged to secure the bicycle properly.

5. Liability of the Hirer

5.1 The Hirer is responsible for all damage caused by negligence or improper use of the rental object to the same or to third-party objects. Any misuse of the vehicle, the transport of one or more additional persons on the luggage carrier and driving over obstacles that could obviously cause damage to the vehicle are not permitted.

5.2 In the event of theft or loss of the rental object or accessories during the rental period, the Hirer shall be liable. The loss will be charged to the Hirer at replacement value.

6. Exclusion of liability of the Rental Firm

6.1 The Rental Firm is not liable for damage caused by the use of the bicycle, unless this is due to wilful intent or gross negligence on the part of the Rental Firm.

6.2 The Rental Firm accepts no liability for injuries or damage to property suffered by the Hirer or third parties while using the bicycle.

6.3 The Rental Firm accepts no liability for weather-related restrictions or unforeseen events.

7. Minimum age of the tenant

7.1 Children and young people under the age of 16 must be accompanied by an adult. Children and young people under the age of 16 who are not accompanied by an adult may only be given rental bikes with the written authorisation of their parents or guardian.

7.2 The minimum age for riders of e-bikes with a maximum speed of 25 km/h is 16 years by law. (Art. 5 para. 2 let. d VZV and Art. 6 para. 1 let. f VZV). Between the ages of 14 and 16, a category M driving licence is required (Art. 3 Para. 3 VZV).

7.3 To hire an S-Pedelec 45km/h, at least a category M driving licence is required (or a car driving licence). M driving licence is required (or a car driving licence). Wearing a helmet is mandatory.

8. Payment and cancellation

8.1 The prices in the price list valid at the time of hire and published in the Lessor’s brochure shall apply, including the discount provisions contained therein. Subject to printing errors. Discounts are only granted on presentation of the relevant ID. Discounts are granted on the spot and are not cumulative.

8.2 The rental price must be paid in full before the start of the rental period. If the rental is cancelled, there is no entitlement to a refund for the remaining rental period not used.

8.3 Cancellations can be made free of charge up to 24 hours before the start of the rental period. After this time, a cancellation fee of 50% of the rental price will be charged.

9. data protection

9.1 The Rental Firm collects and stores the Hirer’s personal data only in accordance with the statutory provisions.

9.2 Data will only be passed on to third parties for the purpose of processing the rental contract or on a legal basis.

10. Final provisions

10.1 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

10.2 Thömus / Thömus Bike World shall endeavour to resolve disputes out of court. Should the parties fail to reach an agreement, legal action will be taken. This contract is subject to Swiss law. The exclusive place of jurisdiction is the Regional Court of Bern-Mittelland BE with its registered office in Bern.
